Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and The Showing, Inc. ("we," "us," "our") governing your use of theshowing.ai and the related applications and services (the "Service"). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and capable of entering a binding contract to use the Service. You agree to provide accurate, current information when creating your account and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

The Service is intended for licensed real estate professionals and the brokerages, teams, or organizations they belong to. If you create an organization account, you represent that you are authorized to bind that organization to these Terms.

The Showing renders short-form video from listing photos and brand information you supply, using a combination of templated rendering and third-party AI generation providers. You select a template and configuration; we run the rendering pipeline and deliver a video file you can download and use in your marketing.

Rendering is performed asynchronously and typically completes within minutes. We do not guarantee specific render times, output quality, or availability of any particular AI provider. Templates, providers, and pricing may change as the product evolves.

Some features are gated to a paid subscription. Subscriptions are managed through Stripe and renew automatically until cancelled. You authorize us to charge your payment method for the recurring subscription fee and any one-time charges (such as overage fees, where applicable) until you cancel.

You can cancel at any time through the in-app billing page. Cancellation takes effect at the end of your current billing period; we do not pro-rate partial periods. Generation credits or quotas are denominated in calendar months and do not roll over.

We do not offer refunds except where required by law. If you believe a charge was made in error, contact us at hello@theshowing.ai and we'll investigate in good faith.

We may update prices for new billing periods with at least 30 days advance notice. Any increase will not apply to your current paid period.

You retain all rights to the listing photos, brand assets, copy, and other content you upload ("Customer Content"). You represent that you have the rights to provide us with this content — including consent from any individuals depicted, and the right to use any logos or branding.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, render, and otherwise use Customer Content as necessary to operate the Service for you. This license includes sending the relevant assets to our AI providers as described in the AI processing section of our Privacy Policy.

The license terminates when you delete the relevant content or close your account, except for backups and audit records retained for the periods set out in the Privacy Policy.

The video output produced by the Service ("Generated Output") is delivered to you for use in your real estate marketing. Subject to your payment of any applicable fees and your compliance with these Terms, you may publish, distribute, and use Generated Output in connection with the listing it was created for.

AI-generated visuals may not exactly represent the property. You are responsible for ensuring any Generated Output you publish complies with your local MLS rules, real estate association guidelines, fair housing laws, and any other applicable regulations regarding photo and video accuracy in real estate marketing. We provide provenance metadata on every render and surface a visible AI disclosure where required by law, but you are the publisher of any output you choose to share.

We do not claim ownership of Generated Output you create with the Service. We may use aggregated, de-identified information about renders (template usage, model performance, render counts) to operate and improve the Service; we will not use the visual content of your Generated Output to train AI models or to market our Service without your prior consent.

You agree not to:

• Upload content you do not have the rights to use, including photos taken by another party without their permission or featuring people without their consent.
• Generate content that is fraudulent, misleading, defamatory, harassing, hateful, or that misrepresents a property in violation of MLS or fair housing rules.
• Use the Service to generate content that depicts persons in sexualized, demeaning, or dangerous contexts.
• Attempt to reverse-engineer the Service, scrape it at scale, or interfere with its operation; bypass rate limits, billing controls, or organization scopes.
• Resell, sublicense, or otherwise commercialize the raw rendering capacity of the Service to third parties as a generic AI video API. Use within your own real estate business or brokerage is expected and welcome.
• Use the Service in violation of any applicable law or regulation.

We may suspend or terminate accounts that violate these terms, including taking down specific Generated Output that we determine in good faith violates these or any applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if your subscription payments fail and remain unresolved, or if we are required to do so by law. Where practicable we will give you notice and an opportunity to cure.

On termination, your right to use the Service ends immediately. We will retain or delete data as described in the Privacy Policy.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that rendering will succeed in any given case; that AI providers will produce particular results; or that Generated Output will meet any specific MLS, association, or regulatory requirement. You use the Service at your own risk.

To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, arising out of or relating to these Terms or the Service, even if advised of the possibility.

Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions don't allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless The Showing, Inc. and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (i) your Customer Content, (ii) your use or publication of Generated Output, (iii) your violation of these Terms, or (iv) your violation of any applicable law or third-party rights. We will give you prompt notice of any such claim and let you control the defense, provided we have reasonable approval rights over any settlement that affects us.

We'd rather solve problems together than fight about them. Before filing a formal claim, please contact us at hello@theshowing.ai and give us 30 days to resolve the issue informally.

These Terms are governed by the laws of the State of California, excluding its conflict-of-laws rules. The exclusive venue for any dispute that can't be resolved informally will be the state and federal courts located in Alameda County, California, and you and we consent to personal jurisdiction there. Nothing in this section limits either party's ability to seek injunctive relief in any court of competent jurisdiction.

These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest stays in effect. Our failure to enforce a right or provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of all or substantially all of our assets.

We may update these Terms from time to time. Material changes will be communicated by email and/or a banner in the application before they take effect, with at least 30 days notice for changes that affect your rights. Continued use after the effective date means you accept the updated Terms.
